Refund and Cancellation Policy

This document is published by Opacity AI Private Limited (CIN: U62011MH2026PTC468882 ; GSTIN: 27AAFCO0822J1ZI ), a company incorporated under the Companies Act, 2013 and having its registered office in Mumbai, Maharashtra, India , which owns and operates the Pindow platform (pindow.ai / pindow.io).

This Refund and Cancellation Policy (the "Policy" ) explains how subscriptions, credits and payments for Pindow, operated by Opacity AI Private Limited ( "Pindow" , "we" , "us" ), may be cancelled, and when refunds are and are not available. This Policy forms part of, and should be read together with, the Pindow Terms and Conditions of Service (the "Terms" ). Capitalised terms not defined here have the meaning given in the Terms.

1. Introduction and Scope

1.1 Pindow provides access to generative artificial-intelligence tools on a subscription and/or prepaid-credit basis. Because the Services deliver digital content and consume third-party compute as soon as you generate, the rules below reflect the nature of those products while preserving any rights you have that cannot be excluded under applicable law.

1.2 Nothing in this Policy limits or excludes any statutory or consumer-protection right available to you that cannot lawfully be limited or excluded, including under the Consumer Protection Act, 2019 (India) or the consumer laws of your country of residence. Where such a right applies, it prevails over any inconsistent provision of this Policy to the extent of the inconsistency.

2. Subscriptions, Billing and Auto-Renewal

2.1 Paid plans are billed in advance on a recurring basis (for example, monthly or annually) at the price and on the billing cycle shown at the point of purchase. Unless stated otherwise, subscriptions renew automatically at the end of each billing cycle at the then-current price, and your payment method is charged, until you cancel.

2.2 By subscribing, you authorise us and our payment processors to charge your payment method for the applicable fees, credits and taxes on each renewal until cancellation.

3. Cancellation

3.1 How to cancel. You may cancel auto-renewal at any time from your Account settings or by contacting support@pindow.ai . Cancellation stops future renewals.

3.2 Effect of cancellation. When you cancel, you retain access to your paid plan until the end of the current paid billing cycle, after which the plan will not renew. We do not provide pro-rated refunds for the unused portion of a billing cycle.

3.3 Cancellation does not automatically delete your Account or Content. You may close your Account separately; data handling on closure is described in the Privacy Policy.

4. Refunds - General Position

4.1 Except where a non-excludable right applies under applicable law, or as expressly stated in this Policy, payments are non-refundable . In particular, we do not provide refunds for:

  • fees for a billing cycle that has already begun, or for the unused portion of a subscription after cancellation;

  • credits that have been used, in whole or in part;

  • generations you are dissatisfied with, where the Services and the relevant Third-Party Model functioned substantially as intended;

  • downgrades, or periods during which you did not use the Services; or

  • Accounts suspended or terminated for breach of the Terms or the Acceptable Use Policy.

4.2 Where we choose to grant a refund or credit as a goodwill gesture in a particular case, that does not waive this Policy or create any obligation to provide refunds or credits in other cases.

5. Credits

5.1 Credits are prepaid units consumed when you generate Outputs or use metered features, at the rates displayed (where available) in the cost estimator before generation. Credits have no monetary value, are not redeemable for cash, and are non-transferable.

5.2 Purchased credits are non-refundable, whether used or unused. Credits may expire as stated at the time of purchase or on closure of your Account; expired credits are not refundable or restored.

5.3 Credits are consumed when a generation request is submitted and are generally not restored merely because an Output is unexpected, aesthetically unsatisfactory, commercially unsuccessful, inaccurate or differs from a user's subjective preferences. Because each request invokes third-party compute, this applies even where you are dissatisfied with the Output. See Section 8 for failures caused by the Services.

6. Free Trials and Promotional Offers

6.1 We may offer free trials, introductory pricing or promotional credits, subject to the terms stated for that offer. Unless cancelled before the trial ends, a free trial may convert into a paid subscription and your payment method may be charged at the applicable price.

6.2 Promotional credits and discounts may be time-limited, non-transferable and non-refundable, and may be withdrawn or modified for offers not yet redeemed.

7. Statutory Cooling-Off and Withdrawal Rights

7.1 If you are a consumer in a jurisdiction that grants a cooling-off or withdrawal right (for example, the 14-day right of withdrawal for certain consumers in the European Union and the United Kingdom), we will honour that right where it applies to your purchase.

7.2 However, where you purchase digital content or services and, at checkout, expressly request that we begin supply immediately and acknowledge that you will thereby lose your right of withdrawal, that right no longer applies once supply has begun. The generation of any Output, or the use of any credit (including a single credit), constitutes the commencement of supply, after which no withdrawal or refund is available under this right, to the extent permitted by applicable law.

8. Failed, Interrupted or Unsatisfactory Generations

8.1 Generative models are probabilistic, and Outputs may vary, be unexpected, or not meet your expectations. Dissatisfaction with the creative result of a generation that was processed substantially as intended is not, by itself, a basis for a refund or re-credit.

8.2 Where a generation fails or is materially defective due to a demonstrable fault of the Services (as opposed to a Third-Party Provider outage, your inputs, or factors beyond our reasonable control), we may, at our discretion, re-credit the credits consumed for that request. Please report such issues to support@pindow.ai with the relevant details.

9. Billing Errors, Duplicate and Unauthorised Charges

9.1 If you believe you have been charged in error, charged more than once for the same purchase, or charged without authorisation, contact support@pindow.ai promptly. We will investigate and, where a billing error or unauthorised charge is confirmed, refund the affected amount.

9.2 Please raise billing concerns with us before initiating a payment dispute, so that we can resolve them quickly.

10. Chargebacks and Payment Disputes

10.1 Initiating a chargeback or payment dispute without first contacting us may delay resolution. We reserve the right to dispute chargebacks we believe are unwarranted, and to suspend or terminate Accounts associated with fraudulent or abusive chargebacks, without limiting any legitimate consumer right you may have.

11. Price Changes

11.1 We may change subscription prices and credit rates prospectively. Changes do not affect a subscription term already paid for and apply from your next renewal, of which we will give reasonable notice. If you do not agree to a price change, you may cancel before it takes effect.

12. Taxes

12.1 Fees may be subject to Goods and Services Tax (GST) in India or equivalent taxes in your jurisdiction. Where a refund is granted, any refundable tax component will be handled in accordance with applicable tax law. Taxes already remitted to authorities may not be refundable where the law does not permit their recovery.

13. How to Request a Refund

13.1 To request a refund or raise a billing query, contact support@pindow.ai with your Account email, the transaction date and amount, and a description of the issue. For unresolved complaints, you may contact our Grievance Officer at legal@pindow.ai .

13.2 Where a refund is approved, it will be issued to the original payment method within a reasonable period (typically 7 to 15 business days after approval), subject to the processing times of your payment provider, card issuer and bank.

14. Changes to this Policy

14.1 We may update this Policy from time to time. We will post the updated Policy with a new effective date and, for material changes, provide reasonable notice. Your continued use of the Services after the changes take effect constitutes acceptance.
